Welcome to Porch2Porch, a platform created by the TRAR Foundation that facilitates the donation and acceptance of fresh food and produce to combat food insecurity and food waste. By signing up as a donor, receiver, or driver, you agree to the following Terms and Conditions, which include a liability waiver. Please read these terms carefully before using our service.

2. Eligibility

You must be at least 18 years old to use the Porch2Porch platform. By registering, you confirm that you are at least 18 years of age.

3. Participation as a Donor

- You will provide accurate and truthful information about the food you are donating.
- You acknowledge that you are responsible for the food you donate and its condition at the time of donation.
- You understand that the TRAR Foundation is not responsible for any negative outcomes resulting from the donation, including but not limited to food spoilage, foodborne illness, or the misuse of your donation by the receiver or driver.
- You acknowledge the potential risks, including the possibility of violent or inappropriate behavior from drivers or receivers, and agree that the TRAR Foundation is not liable for any such incidents.

4. Participation as a Receiver

- You will accept food donations with the understanding that the TRAR Foundation does not guarantee the quality, safety, or condition of the donated food.
- You understand the risks associated with accepting donated food, including the potential for food spoilage, foodborne illness, or receiving food that is unusable.
- You acknowledge the potential risks, including the possibility of violent or inappropriate behavior from drivers or donors, and agree that the TRAR Foundation is not liable for any such incidents.

5. Participation as a Driver

- You will handle and transport donated food responsibly, but you acknowledge that the TRAR Foundation is not liable for the condition of the food upon delivery.
- You understand the potential risks associated with delivering food, including encounters with violent or inappropriate behavior from donors or receivers.
- You agree that the TRAR Foundation is not responsible for any personal injury, loss, or damage that may occur during the course of your delivery duties.

6. Reporting Incidents

- If you experience or witness violent or inappropriate behavior, you must report it immediately via our contact form or email.
- The TRAR Foundation will assist in reporting the incident to the Nashville Police Department if necessary and take appropriate action, including the possible blacklisting of the involved parties.
- The TRAR Foundation reserves the right to suspend or terminate accounts and take further action as deemed necessary to protect the safety and integrity of the platform.

7. Limitation of Liability

- Porch2Porch is a platform that connects donors, receivers, and drivers. We do not control the condition of the food donated, the behavior of participants, or the outcomes of any interactions.
- By using this platform, you agree to release Porch2Porch from any liability for injuries, damages, or losses incurred as a result of your participation.
- The TRAR Foundation is not responsible for any damages, including but not limited to foodborne illness, property damage, theft, or personal injury, resulting from the use of this service.

8. Indemnification

- You agree to indemnify and hold harmless the TRAR Foundation, its affiliates, and its employees from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of or related to your participation in the platform.

9. Agreement and Acknowledgement

- By signing up to use Porch2Porch, you acknowledge that you have read, understood, and agree to these Terms and Conditions and Liability Waiver.
- You accept that you are participating in this service at your own risk and that the TRAR Foundation is not liable for any negative outcomes that may result.
